The California Lemon law provides remedies for purchasers of vehicles that repeatedly fail to meet the standards of quality and performance as provided under the manufacturer express warranty. If a vehicle is purchased “used”, the new owner will usually be protected by the lemon law for the remainder of the warranty. This was the case with a client of ours from Carson, California who bought a certified pre owned (CPO) 2008 Audi A6 from a dealership in Long Beach.

She purchased her used 2008 Audi A6, with only 37,185 miles on it. (The CPO warranty covered the remainder of the manufacturer expressed warranty plus an additional 2 years or up to 50,000 miles.) At 39,608 miles the vehicle’s transmission began to slip and had to be taken in for repairs. The problem recurred at 42,627 miles, and once again had to be taken in for repairs. Two months after the second repair, she was driving on the freeway when the A6 stalled. She lost all breaking and steering assist, making it difficult to pull off to the side of the road safely. Although the experience was unnerving for our client, she returned the vehicle three more times for the same repair. Then someone told her about the California lemon law and the Law Offices of Delsack & Associates P.C.

She called our offices and spoke directly with lemon law specialist Kurt Delsack. After explaining the law and reviewing her documentation, Kurt was confident that she had a strong lemon law case. A retainer agreement was signed and the manufacturer was immediately sent a buyback demand letter.

Approximately 30 days later, our lemon law offices were contacted by Audi with a full buyback settlement for our client. The manufacturer reimbursed her for her down payment, all payments made, paid off her loan, and paid for all attorneys fees. Audi was allowed to charge a usage fee according to the formula set by California lemon law.
