The California Lemon Law states that vehicle owners experiencing repeated repair attempts, that cannot be fixed by the manufacturer or one of it’s approved repair facilities, could qualify for a buyback or replacement of their vehicle. Many consumers do not realize that if the vehicle has been out of service, in the hands of an authorized dealer for more than 30 days during the first 18 months or 18,000 miles, and the problems still exist, they could also qualify for the lemon law protections.

When the Law Offices of Delsack & Associates, P.C. were contacted by the owner of a 2012 Chevrolet Malibu, she already had eighteen (18) repair attempts and her vehicle had been out of service for over forty nine (49) days. She bought the vehicle in November, 2011 and had the first repair attempt approximately four months after purchasing it. Her problems included:

  • Defective Engine
  • Check Engine Light That Remains On
  • Defective Ignition Coils
  • Defective Cylinders
  • Defective Electrical System
  • Transmission Oil Leaks
  • Electronic Stability Control (ESC) Light Remains On
  • Service Engine Soon (SES) Light Remains On
  • Traction Control (TRAC) Light Remains On

After contacting us for advice about her Chevy Malibu problems, she decided to retain our services to represent her in her demand to have GM repurchase the vehicle. Within a few short weeks, we were able to negotiate a repurchase and recover her down payment, monthly payments, and registration. The manufacturer was allowed a mileage deduction as allowed under the California Lemon Law, but because she had owned the vehicle for such a short period of time, the amount was very small. GM also paid the purchase balance in full and all of our attorney fees.

Needless to say, our client was thrilled she discovered the California Lemon Law and was happy to get rid of her defective 2012 Chevy Malibu.
