lexus recall for fuel leaksToyota has announced a Safety Recall involving approximately 245,000 Lexus vehicles to inspect the fuel pressure sensor installation. The problem is being blamed on insufficient tightening of the fuel pressure sensor connected to certain engine fuel delivery pipes (those with Nickel Phosphorus plating), As a result, the pressure sensor could loosen over time leading to a possible fuel leak. The vehicles involved in this recall are:

  • 2006 – 2007 Lexus GS300/350
  • 2006 – 2009 Lexus IS250
  • 2006 – 2008 Lexus IS350

Lexus dealers will inspect the vehicle for fuel leakage and tighten the fuel pressure sensor with the proper torque. If a fuel leak is confirmed, the gasket between the sensor and the delivery pipe will be replaced and the sensor will be tightened with the proper torque. The inspection and work performed will be conducted at no charge to the vehicle owner. Owners will receive a safety recall notice by first class mail once parts are available. Owners wanting more information on the recall can contact Lexus Customer Satisfaction at 1-800-25 LEXUS or 1-800-255-3987 or at www.lexus.com/recall.

Toyota Motor Corporation also announced another recall involving 1.3 million vehicles worldwide to remedy a different condition on a different fuel delivery pipe and a high pressure fuel pump check valve, but this recall does not involve vehicles sold in North America.

A recent recall for improperly heat treated rear axle cross pins on some GM trucks and SUVs is being expanded to include another 25,000 vehicles. The original recall included:

  • 2011 Cadillac Escalade EXT
  • 2011 Chevrolet Avalanche
  • 2011 Chevrolet Silverado LD
  • 2011 GMC Sierra LD

GM told the National Highway Traffic Safety Administration (NHTSA) that it had expanded the recall because some faulty parts were used in production through to Jan. 3 of this year. The new recall includes:

  • 2011 Cadillac Escalade
  • 2011 Cadillac Escalade ESV
  • 2011 Chevrolet Colorado
  • 2011 Chevrolet Silverado
  • 2011 Chevrolet Suburban
  • 2011 Chevrolet Tahoe
  • 2011 GMC Canyon
  • 2011 GMC Sierra
  • 2011 GMC Yukon
  • 2011 GMC Yukon XL

GM said they know of one incident in which a driver experienced a loss of power to the axle, but are not aware of any crashes or injuries related to the condition. They are urging drivers not to use the vehicles until the problem is fixed.

Despite a recall in 2004 and a class action settlement in 2006, Honda and Acura drivers continue to have problems with their automatic transmissions. Over 3,000 complaints have been filed with the National Highway Traffic Safety Administration (NHTSA) in the last two years, with a spike in complaints in the last six months.

The 2004 recall covered the 2003-2004 Honda Accord, 2002–2003 Honda Odyssey, 2003-2004 Honda Pilot, 2000-2001 Acura MDX, 1999-2003 Acura 3.2 TL and 2001-2002 Acura 3.2 CL. The class-action suit that was settled in 2006 claimed that Honda had misled consumers by selling them vehicles with defective transmissions. Honda denied those claims but settled the case without admitting a defect. Owners got their vehicles repaired, or received an extension on their transmission warranties. But now owners continue to have complaints because they continue to experience problems, even after the extended warranties are up. While 2003 model vehicles seem to experience the most problems, complaints have been noted in:

  • 2003-2004 Honda Accord
  • 2002-2007 Honda Odyssey
  • 2002-2008 Honda Civic
  • 2003-2004 Honda Pilot
  • 2000-2002 Acura MDX
  • 1999-2004 Acura 3.2 TL
  • 2001–2003 Acura 3.2 CL

cadillac ctsCadillac, GMC’s luxury line, is recalling over 100,000 CTS’s cars built between 2005-2007. The problem is found in the sensing device in the passenger seat that detects whether there is a passenger in the seat. Over time, the sensor may deteriorate resulting in failure to activate the airbag during an accident. Owners will be notified of the recall by mail before the end of February and may contact Cadillac at 866-982-2339 or the National Highway Transportation Safety Administration (NHTSA) hot-line at 888-327-4236.

California has one of the best new car lemon laws in the country. For someone who can’t or does not want to buy a vehicle brand new, what lemon law rights are there on used cars? Fortunately, there are used car lemon laws to protect the consumer, and thanks to the large automobile industry, it is one of the most utilized legal tools in the United States.

When purchasing a used vehicle, it is best to avoid buying a lemon in the first place. Doing a bit of research beforehand and getting the vehicle surveyed before purchase is a good start. But a lemon car may not always be that obvious. Often, problems start to arise weeks after the purchaser has brought it home. If you have bought a used vehicle that you think could be a lemon, there are a few steps you can take to get rid of it.

To qualify in California for used car lemon law protection, the vehicle must have been purchased or leased in California for personal, family or business use. Vehicles purchased through a private transaction or from a car lot “as is”, usually will not have lemon law coverage. Under the Magnuson Moss Warranty Act and the Uniform Commercial Code consumers can be protected if the vehicle was bought under false representation. False representation can be:

  • Prior history of mechanical problems known to the seller (‘laundered lemon’)
  • A previously salvaged or wrecked vehicle
  • A fraudulently rolled back odometer
  • A vehicle that was a rental car, police car or taxi
  • A stolen, stripped and rebuilt vehicle
  • A vehicle involved in a flood

By California’s Warranty Act, the first time a lemon buyback is resold at the retail level, it must have one-year factory warranty to cover defects and cannot legally be sold “as is.” The law requires that the car be marked as a “lemon law buyback” and must have a “lemon” sticker on the door jamb. When lemon buybacks are illegally sold, the buyer still has rights under the Lemon Law.

The Warranty Act also applies to used vehicles that are still under a manufacturer’s new car warranty. When a used car covered by a new car warranty is sold, any remaining time left in the warranty protects the car’s new owner. The law covers “certified” used cars, lemon vehicles that are bought back by manufacturers or dealers and then resold and automobiles covered by extended service contracts.

Buying a used vehicle does not mean you will get a lemon, but if you do find yourself in this situation, seeking legal counsel from someone who specialized in the lemon law can be your best solution. A lemon law attorney is experienced in these situations and can help you get the compensation you deserve, fast and efficiently.
