Ford has oftentimes refused to repurchase F250, F350, and F450 vehicles under the California Lemon Law Act because it claimed that the gross vehicle weight rating was 10,000 pounds and therefore excluded from the California Lemon Law protections.
California's Third Appellate District in a decision made in September, 2011 ruled, however, that the "gross vehicle weight" as used in the California Lemon Law Act means the actual weight of the vehicle and not the gross vehicle weight rating (which is the vehicle's maximum allowable weight), which Ford has frequently claimed and used to deny legitimate claims for repurchase of these vehicles.
