After analyzing repair orders and the purchase contract of a potential lemon law case, we determined that the owner of a 2010 Chevrolet Malibu did have a valid claim to have his vehicle repurchased under the California Lemon Law. He had complained to the dealer many times about his cars problems and had six (6) unsuccessful repair attempts for various defects. These problems included:

  • Defective Engine Cooling System
  • Defective A/C System
  • Defective Thermostat
  • Defective Temperature Gauge
  • Defective Control Valve Assembly

The Law Offices of Delsack & Associates, P.C. were contacted by the owner of a 2012 Dodge Challenger who believed his vehicle could be a lemon. He bought his car in February, 2013 and started having problems almost immediately. These included defects with the braking system, an air bag light and check engine light that remains on, and a defective fuel sender.

Shortly after purchasing his new 2013 Nissan Pathfinder, a California resident began experiencing transmission problems that would result in loss of engine power while operating under normal driving conditions. He had taken it in for repairs on three separate occasions for problems which included a defective transmission, torque converter, and transmission control module (TCM). The vehicle was also subject to Service Bulletin (NTB12-035) for problems with the TCM and the powertrain control module (PCM), as well as an NHTSA Investigation (DP12004) for transmission damage due to contamination by engine coolant. The Motor Vehicle Owners’ Right to Repair Act, are several bills introduced to the United States Congress last February. If passed, the bill would require automobile manufacturers to give independent repair shops access to the same repair information their approved repair shops have. The legislation hopes to give consumers a choice to pick a repair facility best suited to their particular needs.

It is important to note, however, that under the California Lemon Law, a vehicle owners must give a manufacturer authorized dealer a reasonable number of repair attempts before their vehicle can be considered a lemon. While, the Right to Repair Act will give consumers more choice of where to take their vehicles, it may also negatively affect their lemon law rights. Continue reading
